Status of our York University Class Action, Turner v. York University, March 22, 2010

The offices of Juroviesky and Ricci LLP would like to take this opportunity to update all interested parties as to the status of our York University Class Action, Turner v. York University, which is currently moving towards Certification.Counsel for both the Plaintiffs and York University are currently conducting cross examinations of parties who have submitted affidavit or expert evidence in the Motion for Certification. As of today, the majority of these cross-examinations have been completed.

Prior to the commencement of cross-examinations, counsel for both parties agreed to a Certification Schedule to ensure the timely and efficient progression of this matter. The court approved schedule is as follows:

  1. Delivery of Defendant’s Reply Affidavits to Plaintiffs Responding Materials on the certification motion, if any, by February 19, 2010.

  2. Delivery of Plaintiff’s Reply Affidavits on the certification motion, if any, by March 12, 2010.

  3. All cross examinations to be completed by April 16, 2010 (34 days after reply affidavits).

  4. Undertakings to be completed and any refusal motions to be heard by April 30, 2010 (14 days after completion of cross-examinations).

  5. Plaintiff’s Supplementary Motion Record, Factum and Casebooks to be served and filed by May 31, 2010 (30 days).

  6. Defendant’s Motion Record, Factum and Casebooks to be served and filed by July 9, 2010 (39 days).

  7. Plaintiff’s Reply Factum, if any, to be served and filed by July 16, 2010.

  8. Certification hearing and any related motions to be heard together for three days beginning July 21, 2010.

  9. This case management schedule is without prejudice to the parties' rights to seek future directions; and

  10. The parties agree to make reasonable efforts in good faith to meet these target dates, subject to any agreement between counsel for reasonable extensions of time or any directions by the case management judge to vary or extend the target dates.

The matter continues to progress according to schedule and the Motion for Certification is set to be heard by the court on time as laid out by the schedule.
